Wikipedia did not keep your question. Your AI vendor does.
Late Fee Media is now Late Fee Media AI!
What changed: Wrinkle 008 addressed Tim's IDE. Now theproduct team is in too, brainstorming and virtually testing ideas using with AIsoftware, each software runs somebody else's model under the hood. Two vendors(the software vendor and the AI model vendor) access and process your data. Now todrill down on data ownership and the 3 buckets your engineering and legal teamsshould be able to answer for: o Your INPUT: what you type into the AI (or your IDE). The code that is processed or your product market questions. o Your OUTPUT: what the AI answers back (or even what it updates automatically once you click a button in the software). o Your FEEDBACK: what you tell the vendor. Why is this important? In the era of Wikipedia, you searched for answers and had to answer your own question by applying global information to your specific context. Now, you ask a question with your specific context and the software takes different data from multiple sources and applies it to your specific question and fact pattern. Your output is customized and processed.
So who owns the answer? You? Or the vendor who took yourquestion, identified the data that would answer it and built the customized response?
How would you know? Your terms of service or license agreement should spell it out.
Technology contracts handle this in 3 different ways: o Output is CUSTOMER data. o Output is VENDOR data. Customer gets a license to use it. o Some mix of the two above, which is usually where aggregated and de-identified data lives.
Why should you care? o Vendors: data privacy and data hygiene! Customer data must be deleted, destroyed, or returned along an agreed upon clock. Customer data also has restrictions on your use of it. (Ex: you are not guaranteed the ability to use it for marketing analysis or to build more products.) o Customers: vendor data comes with use restrictions. Most importantly, what happens afteryour 1 year subscription ends? Unless your use license survives beyond the termof the agreement, you bought a 1 year use right to all of the data you generated with the software whether it is code, reports, deliverables, etc.
The fix? o Answer the 3-bucket question before signing the softwareagreement, not at renewal. o If output is vendor data, make sure each party knows what it wants to do with the data and you have the right license (time +use). o Someone owns the answer for each tool. If nobody owns it, that is a flag. Please fix!
